1. Introduction
Welcome to Clientomic LLC ("Clientomic," "we," "us," or "our"). By accessing or using our website, or by engaging our marketing services, you ("Client," "you," or "your") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any part of these Terms, do not use our services.
2. Services We Provide
Clientomic supplies digital marketing and growth services for local service businesses, including but not limited to:
Google Ads, Facebook Ads, and Local Service Ads campaign management
Google Business Profile (GBP) optimization and promotion
Landing‑page design and development
Business listings and local citation management
Conversion tracking and performance analytics
Services included are limited to the package purchased and described on the checkout / order page
3. Client Responsibilities
You agree to:
Provide complete and accurate business information (e.g., licenses, insurance, geographic coverage, and contact details).
Supply timely access, assets, and approvals required to launch and maintain campaigns.
Respond promptly to leads and customer inquiries generated through our marketing efforts.
Operate your business—and all advertising—in compliance with applicable laws, regulations, and platform policies.
All advertising budgets on platforms such as Facebook, Instagram, and Messenger are paid directly by the Client through their own ad account. Clientomic does not fund ad spend on behalf of the Client.
The Client is required to provide all necessary account access, including Google Business Profile (GBP) access, within 21 calendar days from the subscription start date.
Failure to provide required access within this timeframe will result in the account being placed on hold. If access is still not provided, Clientomic reserves the right to cancel the subscription due to inactivity, as services cannot be delivered without access.
4. Fees & Payment
Services are offered on a fixed-price monthly subscription agreed in advance. Your subscription automatically renews at the start of each billing cycle until cancelled. To avoid being charged for the next billing cycle, you must cancel your subscription at least 24 hours before the renewal date through your Stripe Customer Portal at billing.stripe.com or by contacting our support.
If you are charged for a renewal due to missing the cancellation deadline, you have 24 hours from the payment date to request a refund through the same channels. Approved refunds will be issued only if work for the new cycle has not commenced. Fees are due in full on the first day of each billing cycle via an approved payment method. Late or failed payments may result in suspension or termination of services. We may change pricing with 30 days' prior written notice.
Subscription fees paid prior to cancellation due to inactivity or failure to provide required access are non-refundable.
Charges will appear as CLIENTOMIC LLC. For billing questions contact support@clientomic.com. You’ll receive an email receipt after each successful payment.
Cancellation takes effect at the end of the current paid billing cycle (no prorated refunds).
5. Refunds
We guarantee the delivery of all services outlined in your monthly package. Notwithstanding the guaranteed delivery of services and reporting, Clientomic does not guarantee specific Client Key Performance Indicators (KPIs) such as phone call volume, bookings, or revenue growth.
The Client acknowledges that actual commercial outcomes and lead generation are inherently dependent upon external variables outside of Clientomic's control, including but not limited to seasonality, the competitive environment, market demand, and the Client’s ongoing operational quality and rate of new review acquisition.
Except for the limited 24-hour renewal refund window described in Section 4, once work has commenced for a billing cycle, fees are non-refundable as our team allocates time and resources immediately.
Refunds are not provided in the following cases:
• if the Google Business Profile is suspended, restricted, or penalized due to client-side violations (such as inaccurate information, fake reviews, or policy breaches);
• if performance is affected by force majeure or external platform issues (including algorithm updates, outages, or account bans);
• if the Client fails to provide required access, approvals, or communication;
• if all promised content has been prepared and delivered but the Client fails to provide Google Business Profile access for publishing — in such cases Clientomic will supply the completed materials together with step-by-step upload instructions for the Client to self-publish;
• if the Client fails to complete the required onboarding form in a timely manner, causing delays in the delivery timeline;
• if the Client’s business is unlawful, non-compliant, or lacks the necessary licenses, permits, or regulatory approvals to operate; or
• if the service package was purchased with a discount.
Clientomic is not responsible for any performance changes or ranking outcomes if third parties (including other agencies, contractors, or the Client’s staff) make edits, updates, or adjustments to the Google Business Profile during the service period, or if the Client’s overall review rating decreases compared to the rating at the start of our engagement.
Client acknowledges that Search Engine Results Page (SERP) reporting requires a valid, publicly visible business address associated with the Client’s Google Business Profile. If the Client does not have a physical address listed in their Google Business Profile (including service-area–only profiles with hidden addresses), Clientomic is unable to generate or provide SERP ranking reports. The absence of an address does not constitute a failure to deliver services and does not entitle the Client to a refund, partial refund, or service credit.
For the purposes of these Terms, services are considered commenced once the subscription is activated and internal resources are allocated, regardless of whether publishing, optimization, or live deployment has occurred.
6. Privacy & Data Protection
We process personal data in accordance with applicable privacy laws, including the California Consumer Privacy Act (CCPA). You agree to:

7. Limitation of Liability
Clientomic shall not be liable for any indirect, incidental, special, punitive, or consequential damages — including but not limited to loss of business, revenue, profits, goodwill, or data — even if advised of the possibility of such damages. Our total liability for any claim related to our services shall not exceed the total amount paid by the Client for the specific package giving rise to the claim.
We are not responsible for performance issues or visibility loss resulting from client violations of Google policies, business profile suspensions, inaccurate or misleading business information, non-compliant reviews, force majeure, or platform-level changes such as algorithm updates, bugs, or outages. All services are provided “as is,” with no warranty or guarantee except as explicitly stated in these Terms.
8. Indemnification
You agree to indemnify, defend, and hold Clientomic and its employees, contractors, and affiliates harmless from any and all claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising out of or related to your use of the services, your violation of these Terms, your business practices, or any content or data you provide. This includes, but is not limited to, claims related to false business information, non-compliant reviews, customer disputes, or regulatory actions.
9. Dispute Resolution
Any unresolved dispute shall be resolved exclusively by binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in Sacramento, California, USA. The Client waives any right to a jury trial or to participate in class actions, group claims, or representative proceedings. By using our services, you agree that arbitration is the sole and exclusive remedy for any dispute with Clientomic.
10. Term & Termination
These Terms remain in effect while you maintain an active subscription.
You may cancel your subscription at any time. To avoid being charged for the next billing cycle, you must cancel at least 24 hours before the renewal date through your Stripe Customer Portal or by contacting Clientomic support, as described in Section 4. Once canceled, your subscription will remain active until the end of the current paid billing cycle unless otherwise stated in Section 4.
Clientomic may suspend or terminate services (and/or cancel the subscription due to inactivity) if the Client fails to complete onboarding requirements, fails to provide required account access within the timelines stated in these Terms, or otherwise prevents service delivery.
11. Changes to These Terms
We may update these Terms at any time. Updates take effect upon posting on our website. Material changes will be announced by email or site notice at least 14 days before they become effective.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict‑of‑law principles.
